Ford & Warren's Catastrophic Injury Team has considerable experience of handling catastrophic injury and fatal accident claims.

The Catastrophic Injury team acts for both Claimants and Defendants - the benefit of this is that they are used to seeing the claims process from both sides, which is an advantage over firms who only act exclusively for Claimants or Defendants.

How to Make a Claim

A claim will typically involve the following:

  • Enquiries and advice on liability (was the Defendant at fault? what are the prospects of proving the prospective Defendant was at fault?). This may involve expert evidence.
  • Enquiries on causation (did the fault alleged cause the damage? In many cases this will be obvious but in some cases it will not be clear-cut). This too may involve expert evidence.
  • Enquiries to ascertain the level of damages that are appropriate.  This might  include the obtaining of reports from medical experts in appropriate fields, reports on the type/level of care required, reports on any aids & equipment required, reports on treatment and therapies required in the short term and long term, a report on the need for special or adapted accommodation. It is usual in catastrophic injury cases for both parties to obtain their own medical reports.
  • Input from Leading Counsel as appropriate.
