Insolvency and Corporate Recovery

Our insolvency and corporate recovery department provides a full range of insolvency, corporate recovery and turnaround services and works closely with other teams within the firm particularly the commercial, property and debt recovery departments.
The team is experienced in both contentious and non-contentious aspects of insolvency and has a reputation for combining strong technical advice with a sound commercial approach at reasonable charge rates.

Our clients include:

Insolvency Practitioners (national accountancy practices, medium sized and small firms), Companies, Lenders, Creditors, Directors, Shareholders, Individuals and Partnerships.

Corporate Insolvency

We advise Insolvency Practitioners in their roles as Liquidators, Administrators and Receivers of Companies. This includes advice on the realisation of assets, business and asset sales, proceedings to overturn transactions under the Insolvency Act 1986 such as transactions at an undervalue, preferences and breach of duty claims against directors. We also act for directors of distressed companies who require advice on the options available and assist them in the event of a formal insolvency procedure including advice on any purchase by them of the business and assets.

Personal Insolvency

The department acts for Insolvency Practitioners as Trustees in Bankruptcy in all aspects of asset realisations, recovery and other proceedings under the Insolvency Act 1986. We also advise individuals and partnerships with financial problems and those that have been made bankrupt and their wives/husbands particularly in relation to the family home and actions threatened or taken by the Trustee in Bankruptcy. We also advise in connection with insolvent deceased's estates.

Turnaround and Voluntary Arrangements

We assist companies, individuals and partnerships who are having financial difficulties and advise on the alternatives to formal insolvency procedures. This can including restructuring, refinancing and voluntary arrangements.

Directors and Shareholders

We regularly advise directors on their duties to the company and its creditors and we act for directors against whom claims are been made by Liquidators, Administrators and other office holders and in defending Company Disqualification Act proceedings and claims arising under personal guarantees.

Lenders and Creditors

Secured and unsecured lenders and creditors frequently instruct us to review their enforcement options and to formulate a strategy for maximising their recoveries from distressed companies, individuals and partnerships. We also deal with the completion and lodging of proofs of debt and proxies.
