Financial matters on divorce

What will happen to the family home? Will I have to sell my business? How will the children's school fees be paid? The settling of financial matters upon divorce is called ancillary relief. It is usually far more complex that the divorce itself. Cohabitation

Many couples live together but do not marry and often there are children involved. The law has not kept pace with society. Cohabitants are not entitled to bring financial claims against each other in the same way as separating married couples can. The law that applies in these situations is a hotchpotch of different provisions which are complicated and unpredictable. If you are intending to live together we will help you prepare for the future with drafting Cohabitation and Pre-Nuptial Agreements and provide creative solutions for separating parties to resolve their financial issues.

Children

Child custody is now known as “residence” and access as “contact”. The courts do not automatically get involved when parents divorce or separate, it is felt that it is better for the parents to try and come to an agreement themselves. If the parents were married then both will have parental responsibility for a child, if they were not married then the father may not automatically have parental responsibility. Parental responsibility means all of the rights, duties, powers, responsibilities and authority which by law a parent of a child has in relation to the child and his property.

Disagreements concerning the arrangements for bringing up children after divorce or separation can be the most heated and emotionally charged. They have on thing in common, it is not the fault of the children, the difficulties arise because of the adult conflict. We can put you in touch with Family Mediation services but where this is not appropriate or successful in resolving your disagreements then we can advise, and represent you in court, on all matters involving children including, contact and residence disputes, parental responsibility, changes of name and removal from the jurisdiction (abduction).
